A ruling this week will allow a widow to continue her asbestos lawsuit in New York. The lawsuit is against a cable manufacturing company that supplied items to her husband’s company, which contained asbestos.
The asbestos lawsuit of a former New Jersey resident will be allowed to move to New York after a ruling by a Supreme Court Justice this week. The lawsuit is against a cable manufacturing company that produced asbestos-containing materials that were used by her husband while working in the Brooklyn Naval Yard. The man dies of mesothelioma, a form of cancer that is directly linked to asbestos exposure. The case was moved to another state since the elderly widow now resides in New York, and since the deceased worked in New York.
Asbestos can cause many types of respiratory diseases, including mesothelioma, emphysema and asbestosis. Though emphysema can result without exposure to asbestos, both mesothelioma and asbestosis result when asbestos fibers are breathed in. Mesothelioma occurs when asbestos fibers become lodged in the lungs, keeping the tissue from absorbing oxygen and slowly suffocating the victim. The case is scheduled to begin in June of 2007, and could result in a large settlement for the widow; most victims of mesothelioma do not live long enough to see the verdict of their own case.
