The trial of vermiculite mining company WR Grace has been delayed until 2007. The decision to delay the trial of the company and a number of its executives comes after a federal judge ordered the dismissal of a central allegation against Grace.
The delay has been caused because the 9th Circuit Court of Appeals must now decide whether to uphold the orders from the federal judge or whether to press ahead with the allegation as prosecutors want. The prosecution in the case has stated that the federal judge has picked the case to pieces.
The trial was due to begin on September 11th of this year, but must now be delayed until the court of appeals has reached its decision, which must be made by January 9th, 2007.
The chief district judge said in a statement: “The scheduled start date of this trial is Sept. 11, 2006. The court has insisted on this start date in a desire for a speedy and efficient resolution of this case. It appears that desire will be unfulfilled.”
