A second-hand mesothelioma lawsuit has been filed by a woman who claims that she developed the asbestos related cancer as a result of asbestos fibers and dust being brought home on her husband’s clothing. Nearly eighty defendants have been named on the lawsuit.
The lawsuit, which was filed in February, states: “Dust created by working with and around asbestos and asbestos-containing products would permeate the person and clothing of the plaintiff’s former husband,” states the complaint. “This dust contained asbestos fiber.”
According to the lawsuit, after the dust and fibers were transported home on the clothing of the husband it would become airborne once again, this time in the home, where it was breathed in by everyone in the property. “The plaintiff would be repeatedly exposed to this asbestos dust from her former husband’s person and clothing.”
The plaintiff is seeking punitive damages that are “appropriate and necessary in order to punish defendants for their wilful, wanton, intentional and/or reckless misconduct and to deter defendants and others from engaging in like misconduct in the future.” She seeks in excess of four hundred thousand dollars in damages.
