Asbestos Case Heard in High Court

Both sides of an asbestos case were heard this week, and now it is up to the Supreme Court of Tennessee to decide if the case will go to trial. The case involves a father suing on behalf of his daughter, who died from mesothelioma.

The Supreme Court in Tennessee has heard arguments both for and against the case of a mesothelioma victim going to trial. Now it is up to the court to decide if that will happen. The father of a mesothelioma victim is suing his former employer on behalf of his deceased daughter. The girl was exposed to asbestos that was on the clothing of the man when he came home from work. The employer states that they have the responsibility to protect employees only.

The man states that, since he was exposed to asbestos at work, that the company should have taken precautions to make sure that immediate family members were not in danger. The man has been exposed to asbestos, and may develop mesothelioma later in life. Mesothelioma is a type of aggressive lung cancer that results from breathing in asbestos fibers. The man’s lawyer stated that the company does not have to protect everyone, just those immediately living with employees that have been exposed to asbestos.
