Class action suits pertaining to mesothelioma and asbestos exposure began to be filed in the late 1960s, when public health experts were first publicizing the dangers of asbestos use and its association with the development of deadly diseases, including malignant mesothelioma. Defendants in asbestos-related class action suits were mining companies, manufacturers, distributors and installers of asbestos-containing products whom the records show were aware of the risk of asbestos exposure but who neither informed their employees of the danger nor took any action to protect them.

Federal Mesothelioma Class Action Lawsuits

Federal courts have looked unfavorably on the aggregation of asbestos plaintiffs into a single class for the purposes of litigation.

By the 1980s, the dangers of asbestos exposure were so well known, and the number of victims suffering from asbestos-related diseases so high, that over 750,000 related claims were pending in state and federal courts. This created great logistical difficulties, for each case would need to proceed within a tremendously backlogged judicial system. In 1991, in an effort to resolve this administrative problem, federal judges consolidated asbestos litigation pending in federal courts into a single venue before the U.S. District Court for the Eastern District of Pennsylvania. Multi-district asbestos litigation, known as MDL 875, is still handled in this manner to this day.

The judge presiding over the MDL did not implement the global settlement between plaintiffs and asbestos company defendants that was expected, however, so plaintiffs and defendants took matters into their own hands. A group of manufacturers of asbestos-containing products formed the Center for Claims Resolution (CCR), charged with negotiating a settlement with plaintiffs. Since an actual trial would be both expensive and time-consuming, plaintiffs and defendants filed a joint motion to certify a class along with a proposed compensation as Georgine v. Amchem Prods., Inc.

The motion was debated all the up to The U.S. Supreme Court which refused to allow it, arguing that the asbestos claimants represented too many diverse interests to represent a class under federal law.

In 1999, the Supreme Court ruled similarly on another case, Ortiz v. Fibreboard Corp., that attempted to certify asbestos plaintiffs as a single class.

State Individual Actions

As a result of the forgoing, individual claims for mesothelioma are the common way to seek redress from the manufacturers of asbestos. In an individual state claim, a person can seek redress two ways. 1)civilly thru litigation and 2) against trust funds that have been created for people that have developed asbestos related diseases.
